Family man stabbed victim after driveway death threat in Gainsborough
A Gainsborough man has been given a suspended jail sentence after stabbing another man during a confrontation in the early hours of the morning.
Stuart McGhie armed himself with a kitchen knife after being told a group of men were making threats outside his home. Jonathon Dee, prosecuting, said there was a confrontation in McGhie's driveway. McGhie produced the knife in response to a threat that he was about to be killed.

He told the men to go away. One of the men swung a punch and McGhie responded by stabbing the man in the chest.
The victim suffered a deep cut which penetrated his left lung. He tried to make his way back to his own home but found himself in difficulties and was taken to hospital.

McGhie, 42, of Balfour Street, Gainsborough, admitted unlawful wounding on December 3, 2011.
He was given a nine month jail sentence suspended for a year and ordered to perform 60 hours of unpaid work.
Passing sentence, judge Michael Heath told McGhie: "You didn't deliberately go to stab him and the injury was not life threatening."
Michael Cranmer-Brown, defending, said McGhie had not been in trouble for seven years and urged that he should not receive a jail sentence.
He said: "He is a working, family man who wants to put this behind him."

“Confronted a group of men after arming himself with knife?
Clearly Mr McGhie is a former CIA assassin who has had his memory erased and been placed in some relocation scheme that somehow failed.
I'm not usually in favour of instant jail regardless, but I think a stabbing causing a punctured lung using a weapon deliberately taken to an affray, even when the victim is not without fault, maybe outweighs a job and a family.”

“The man hadn't been in trouble for 7yrs so even if he had killed him the fact that he had not been in trouble for 7yrs would have still kept him out of jail!!!”

“judge Michael Heath told McGhie: "You didn't deliberately go to stab him and the injury was not life threatening."
Why do all of our Judges appear to be fools.
1. McGhie armed himself with a kitchen knife before going outside. In my book he went out with the intention to deliberately stab someone.
2. "The victim suffered a deep cut which penetrated his left lung." This could obviously have been life threatening
3. McGhie could have called the Police instead !”
