Lincolnshire man's car seized for anti-social driving
A Vauxhall Corsa has been siezed by police after it was being driven in an anti-social manner on Pinchbeck Road in Spalding.
The incident occured in the early hours of August 27.

Section 59 of the Police Reform Act gives police officers the power to seize vehicles being used in a manner which causes alarm, distress or annoyance if the driver or the vehicle has been subject of a previous warning in the last 12 months.
A previous warning had been placed on the vehicle on August 19 and the driver of the car, a 23 year-old Cowbit man, has also been reported separately for driving offences.

Inspector Jim Tyner said, "Several drivers have received warnings under this legislation in recent weeks, so this seizure should remind them that, if they are caught on a second occasion, we can and will seize their car".

“DontBuyTheSun. Everyone has their own interpretation someone being a prat, but if your neighbour sits in their car, on their drive, playing loud music or likes the sound of their big bore exhaust, that's not illegal, but could cause annoyance or distress. The same goes for drivers who do donuts etc. in shop car parks. Before, the Police were limited to what they could do, but now have the section 59. Whether they abuse this power, is another thing.
Poor taste in female company. Hmm. That's like riding an old moped. Great fun until your mates find out. I should keep the false nose.
Roadscource. Taking someones licence away, only stops law abiding people from driving. If someone has no regard for the law then having a licence doesn't make an iota of difference.
Even you must realise it's easier to drive without a licence than a car.”

“"Roadscource. to simplify this for you"
"gsx1100" let me put this in really really ultra simplistic terms for you.
Taking someones vehicle from them does not prevent them from driving, taking their licence from them does.
Even you might be able to understand now i reckon.”

'"Roadscource. to simplify this for you. It means that if anyone in charge of a motor vehicle who is being a prat, whilst not breaking the motoring laws, gets a warning.'
........
Sorry lad, still not 100% sure of what constitutes being a prat as opposed to doing something illegal. Not wanting to start an argument, but I just cant get my head round this one.
If Ive crept over the speed limit for example, and a plod, rather than issue the fine and points, then gives me a warning, I would expect a harsher penalty if I foul up again. Possibly with the earlier act of naughtiness being taken into account. Like being bound over for vehicle drivers.
If however, Im pulled over because my music is too loud, Im wearing a false nose, I have a poor taste in female company or even all three, then Im sure there must already be legislation in place to tackle the misdemeanour?
Im not too familiar with the workings of the law, but I never saw Judge John Deed send down a `****** for being a prat. Although Im not saying he shouldnt have done!
Perhaps a member of 5-0 can help?”

“If the Police had described what driving in an Anti-Social manner really meant the general public would be much the wiser instead of coming up with their own opinions as to what is meant by that statement.”

“We can sit here moaning about legislation, least the loony has no car to be a prat in and end up killing someone, and has a levy to pay to get it back.”

“"siezed by police after it was being driven in an anti-social manner"
Is this a watered down "driving without due care" for which there was already law in place and could have been persued resulting in suspension of licence or penalty point endorsement.”
