Supermarket giant Asda has won costs after claiming victory in a row over deliveries at its North Hykeham store.

The company applied to extend the permitted delivery period to the Newark Road site from 6.30am and 7pm to between 5.30am and 10.30pm.

But North Kesteven District Council refused after residents complained about the threat of increased "noise and disturbance".

Asda won on appeal and the planning inspector agreed it could claim "partial costs" over objections about light pollution which the council failed to withdraw.

Little evidence was produced to support this claim and Asda forked out for a statement to respond to it.

But in overturning the council's decision, the planning inspector added a new replacement condition.

Deliveries can now only be made to the supermarket between 6.30am and 10.30pm Monday to Saturday and from 6.30am to 7pm on Sundays and bank holidays.

Meanwhile, nearby residents remain sceptical about whether Asda is complying with the conditions.

"I saw lorries there just after 6am yesterday and at 6am on Saturday," said Sharon Roe (41), of Newark Road, North Hykeham.

"The worst thing for me is the noise.

"When I noticed a lorry at 6am on Saturday I called Asda to see if they were going to turn the truck away but didn't really get an answer.

"I've also been on to the council and they've advised me to keep a diary of events."

An Asda spokesman said that restricting deliveries to 7pm was an old condition dating back to 1997.

"The main reason for us wanting to change this condition was so we can ensure the store is well stocked," he said.
