Travellers pitched near West Common to be served legal notice to move on

TRAVELLERS who have pitched up near Lincoln's West Common will be told to move on by council officials.

Several caravans and four-wheel drive vehicles appeared on the leafy, secluded land close to Carholme Road roundabout on Friday night.

According to reports, the group first stopped on the West Common.

But residents protective of the land told them they could not stay as vehicles are not permitted on the land by law.

Now, the City of Lincoln Council, which is responsible for the nearby patch of land they moved to, says it will serve a legal notice.

Carolyn Wheater, head of corporate support services at City Hall, said: "The council has a legal duty to consider any welfare issues of the travellers, prior to commencing any enforcement activity, so we are currently arranging a visit to the site today to make this assessment and provide services where needed.

"Once this assessment has been made, we will draw up a legal notice to serve on the group requesting them to move off the site and will work with the people in the group to resolve the situation as soon as possible."

People in the West End area of Lincoln have just recovered from a battle against plans to build a racecourse on the common.

They are worried there could be another one on the horizon.

But George Woolfenden, of the West End Residents' Association, said he was not too concerned.

"It doesn't really bother me. They did drive onto the common. They took a lock off and drove onto the old racecourse," he said.

"If they are on the common they can be removed because vehicles are not allowed.

"Some residents went down there to talk to them and tell them they would have to move on and they were quite polite people."

It is thought that the travellers are the same group the Echo talked to in July. They were staying on playing fields in Waddington but following a visit from a member of the village's parish council, they left.

They told the Echo they were in the area to be close to a sick relative in Lincoln County Hospital.

Carholme Ward councillor Neil Murray said: "When they arrived on Friday, we were concerned for the security of the horses in particular.

"It is the West Common and no-one has the right to move onto it like that.

"It's not good at all, but some people think they can pitch up anywhere they want. This is not about discriminating against travellers, no-one should go on there."

    “What is disturbing that a police officer was there when they entered through the gate onto the racecourse. He failed to apprehend them causing criminal damage. He failed to call for back up. His excuse that it was common land. The officer was told that the common was protected by statutory law which appears that this was dismissed by him and believed too by his superiors.
    It is no wonder people mistrust the police and do not report crime. For what happened last Friday evening was blantantly disregard to law by both the police and the travellers.
    What are the police going to do to rectify the situation for they are losing public confidence in upholding the law. In this occassion they failed miserbly. Is the chief constable listening? No, he has been at cheese and wine parties hob knobing with bankers to get a secure loan for a second home in the wolds - just like what our politicians do!”

    “I saw them arrive in flashy 4x4's, park at the golf course outside the stables. 2 chaps walked across the road rattled the double gates to the racecourse, some metal clunking went on (please excuse the sound effect) and they threw open the gates - all in broad daylight! I shouted and waved to them but they ignored me (must engage brain before I fly into protective mode next time). They then drove across the road onto the racecourse and down to the far end. When I got down there low and behold the post & rail fencing was knocked down and they were onto the field. What you can't see is the damage done to the fence which is to the right of the photo above. This was all reported but not acted on as it was far too late??!! How can anyone justify this kind of action?”

    “I would emplore anyone moaning about "human rights" to actually read what they are. They are what ensure people are treated with respect in many situations. They are not some sort of dirty phrase, nor something that should be seen as a nasty piece of legislation. When a paper reports that someone has appealed on the basis of human rights, they rarely follow it up where it gets thrown out. Put down the Mail and have a look at the propper legislation”

    “While travelling out of town I saw 2 of the community motorcyclists picking up the 2 fixed bollards which had clearly been removed by the 'travellers'. These bollards were installed in the middle of the gateway after the travellers last visit to this field on Carholme road. Surely ripping these bollards up is criminal damage. Or is this now allowed if I claim its in my human rights to deface other peoples property.”

    “Actually a dozen caravans were seen on the former racecourse when travellers decided to break the lock to gain entry. I saw them on this part of the common when using Saxilby Road heading for the round about.
    On my return journey later there was a 4by4 towing a caravan which went through a gateway to the land travellers are now occuping at present.
    I understand they came to the West Common after being evicted from using land in the Brant Road area of Lincoln.
    They have broken the law and should not be exempt whatever their explanations. They could have used the empy spaces for travellers near Cannick cemetery on road to Washingborough. There is an official site there.
    No sympathy from me. And why should I pay taxes to clear up the mess they leave behind. It happened on the other two commons with two grand paid out to clear up the mess left behind on the South Common.”

    “Is what we see in the photo it? Two caravans, two cars and a transit flat bed. Whats the odds that they maybe have some work on in the area or are maybe here to visit relatives in hospital. Family ties are very important to the proper gypsies. I wouldn't be surprised if those weren't just travelling vans with much bigger smarter permanent homes elsewhere. Personnally I can't see what harm they are going to do if that is it.

    As for the law. It seems to me that they moved from the common with no argument having been told by locals of the laws concerning vehicles on the common land with no intervention from the council or police. and as George Woolfenden said, they were (shock horror) polite people. I dont think the police could actually do anything anyway because it is probably a civil law matter. If the police are there when the council serve court orders its only in case some one pops a council jobsworth which would be a criminal matter.”

    “The land in question being used by the travellers is actually rented to a nearby farmer. I have seen cows grazing on there as well as sheep.
    These folk did break the law when entering the West Common. The Act protecting the common states that camping is forbidden. It also forbids vehicles using it too.
    Having checked with City Hall, the instances about the other two commons involved were about human rights to include their welfare, hence piped water allowed on the Cowpaddle. With the South Common, the travellers left a right mess after their departure. Another thing not mentioned by the council, it was the council who left the gate open in the first place on the South Common, hence the word out for occupation.Our three commons are a gem. Each time travellers have been on the three commons they have left their rubbish and their mark to be paid for by the taxpayer.”
